These Terms of Service ("Terms") are a binding agreement between you ("you", "Customer") and PinScout ("PinScout", "we", "us"), operator of the lead-generation platform available at pinscoutleads.com and its subdomains (the "Service"). By creating an account, purchasing credits, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
PinScout is a business-intelligence tool that helps you compile publicly available business listing information (such as business names, categories, addresses, phone numbers, websites and publicly listed social profiles) from online sources, and deliver that data to you as exportable "leads". The Service is provided on a prepaid, credit-based model. We may add, change, or remove features at any time.
2. Eligibility & Accounts
- You must be at least 18 years old and able to form a binding contract.
- You are responsible for the accuracy of your registration details and for all activity under your account. Keep your password and API keys confidential.
- You must verify your email address before running crawls. One person or entity per account unless a team/seat plan is in effect.
- Notify us promptly at [email protected] of any unauthorized use of your account.
3. Credits & Billing
- Access to paid features is purchased as credits. Pricing is shown on our Pricing page. A crawl reserves credits up front and settles against the leads actually delivered.
- Payments are processed by our authorized reseller and Merchant of Record, Paddle (Paddle.com Market Ltd). Paddle handles the transaction, invoicing, and applicable sales tax/VAT. Your purchase is also subject to Paddle's buyer terms.
- Purchased credits are non-transferable. An unused credit pack may be refunded within 14 days; once any credit from a pack has been spent, that pack is final and non-refundable (except for genuine billing errors or where required by law), as set out in our Refund Policy.
- Credits do not expire while your account is in good standing, but they carry no cash value and cannot be redeemed for cash.
- We may change prices prospectively; changes never affect credits you have already bought.
4. Acceptable Use
You agree that you will not, and will not permit anyone to:
- Use the Service or the data it returns in violation of any applicable law, including data-protection, anti-spam, telemarketing (e.g. TCPA, CAN-SPAM), and consumer-protection laws.
- Send unsolicited bulk communications, harass individuals, or use leads for fraud, scams, or any unlawful, deceptive, or harmful purpose.
- Resell, sublicense, or redistribute raw Service data as a competing dataset or directory without our written permission.
- Attempt to breach, probe, or disrupt the Service, circumvent rate limits or credit metering, reverse engineer the platform, or overload our infrastructure.
- Scrape, crawl, or harvest data on our behalf in a way that violates a third party's terms, or upload unlawful content or malware.
You are solely responsible for how you use the data you obtain, including obtaining any consent required to contact the businesses or individuals in your leads.
5. Data Accuracy
Lead data is compiled from third-party public sources and is provided "as is". We do not guarantee its accuracy, completeness, deliverability, or fitness for a particular purpose. You are responsible for validating leads and for compliance with do-not-contact registries before using them.
6. Intellectual Property
The Service, including its software, design, and branding, is owned by PinScout and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for your internal business purposes. The lead data you export for your own use is yours to use subject to these Terms and applicable law.
7. API
If your plan includes API access, you must keep your API keys secret and stay within your plan's rate limits. We may throttle, suspend, or revoke keys that abuse the API or endanger platform stability.
8. Suspension & Termination
We may suspend or terminate your account for breach of these Terms, non-payment, or unlawful use. You may stop using the Service at any time. On termination for cause, unused credits are handled per our Refund Policy. Sections that by their nature should survive termination (e.g. IP, disclaimers, limitation of liability) will survive.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or secure.
10. Limitation of Liability
To the maximum extent permitted by law, PinScout will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total aggregate liability arising out of or relating to the Service will not exceed the amount you paid to us in the three (3) months preceding the event giving rise to the claim.
11. Indemnification
You agree to indemnify and hold PinScout harmless from any claims, damages, and expenses (including reasonable legal fees) arising from your use of the Service or the data, or your breach of these Terms or applicable law.
12. Changes to These Terms
We may update these Terms from time to time. Material changes will be posted on this page with a new "Last updated" date. Your continued use after changes take effect constitutes acceptance.
13. Governing Law
These Terms are governed by the laws of the Republic of the Philippines, without regard to conflict-of-laws rules. Disputes will be resolved in the competent courts having jurisdiction there, unless otherwise required by mandatory local law.
